Medicaid asset protection trusts

Protect your home and savings if you ever need long-term care.

A Medicaid asset protection trust, set up well before care is needed, can help preserve what you’ve built for your family while keeping the door open to Health First Colorado (Medicaid) later.

Medicaid Asset Protection Trusts in Colorado

The basic idea

Move assets into the trust now, so they are protected later.

Once the trust has held your assets for five years, they generally no longer count toward Medicaid eligibility.

  • Step 1

    Transfer your home and savings

You sign the trust and retitle assets into it, while you are healthy and care is not on the horizon.

  • Step 2

    An irrevocable trust holds them

A trustee you choose, often an adult child, manages the assets. You can keep living in your home. Income from the trust can still be paid to you.

  • Step 3

    What you built passes on

After the five-year look-back, the trust assets are generally protected, and pass to your family as you planned.

An honest look

What you keep, and what you give up.

This trust is a real commitment. We will walk through the trade-offs with you before you decide.

What you keep

  • The right to live in your home
  • Income the trust assets earn
  • A say in who inherits, if the trust allows
  • Possible tax benefits for your heirs

What you give up

  • Direct access to the principal
  • Serving as your own trustee
  • The option to undo it later

Medicaid only stops counting assets you no longer control.

Is it right for you?

This trust works best when you plan ahead.
